Step 1: Find out if the ONCA applies to your nonprofit
If you’re incorporated as a nonprofit under Ontario’s Corporations Act, then the Ontario’s Not-for-Profit Corporations Act (ONCA) applies to you.
If you’re incorporated under:
- the Canada Not-for-Profit Corporations Act or another law outside of Ontario,
- Incorporated under Ontario’s Co-operative Corporations Act,
- Not incorporated
then the ONCA does not apply to you. This means you don’t need to make any changes to your articles and bylaws.
In most cases, the ONCA will also apply to nonprofits incorporated under other Ontario laws and statutes. For example, the ONCA will apply to horticultural societies and conservation authorities incorporated under other laws.
